Abstract:
The idea of a-national arbitral award, which detaches an award passed in international arbitration from national legal orders and grounds it in an autonomous arbitral order, is projected to make international arbitration truly international. This idea has already been accepted by the French courts. The present paper analyses the progression of this idea in France and tests whether it is in consonance with the New York Convention of 1958, which regulates the enforcement of foreign arbitral awards globally. The paper further analyses whether such an idea is conducive to the growth of international arbitration.
