Abstract:
The article posits the amenability of data-related disputes to arbitration as a dispute resolution mechanism. In this context, the article outlines an overview of India’s data protection regime and juxtaposes it against those in the European Union and Singapore. The article then examines the legislative or judicial basis for determining the arbitrability of disputes in each jurisdiction. Finally, the author explores and makes a case for explicitly providing for arbitration as a mechanism for resolving private data-related disputes in India’s emerging Digital Personal Data Protection Act 2023 framework.
