Abstract:
The Constitution Bench of the Supreme Court of India by 03:02 verdict in N.N. Global Mercantile Private Limited v. Indo Unique Flame Ltd and Other[2023 SCC Online SC 495], while examining the enforceability of an arbitration agreement contained in an unstamped contract held that such contracts are void and reference to arbitrator under section 11 of the Arbitration and Conciliation Act, 1996. This paper presents a critique of this judgment and analysis its impact on the arbitration regime in the country.
